What is a Guardian Ad Litem in Nevada?

A Guardian Ad Litem (GAL) is a person appointed by a court to represent the best interests of someone involved in a legal case. In Nevada, this is often used in cases involving children or adults who cannot fully protect their own interests.

  1. Purpose of a Guardian Ad Litem
The GAL’s role is to make sure the court has all the information it needs to make decisions that are in the best interest of the person they represent. They do not act as a parent or guardian who makes everyday decisions but instead focus on providing an unbiased perspective in legal matters
    .
  2. When is a Guardian Ad Litem Appointed?
A GAL may be appointed in various cases, including:
    • Child Custody Disputes: When parents cannot agree on custody or visitation, the GAL investigates and reports what arrangement would best support the child’s well-being.
    • Child Abuse or Neglect Cases: A GAL represents the child’s interests to ensure they are protected and receive proper care.
    • Guardianship Cases for Adults: If an adult is unable to advocate for themselves due to disability or incapacity, a GAL may step in to assess their needs and advise the court.

  3. Duties of a Guardian Ad Litem
    The GAL is responsible for:
    • Investigating the case by interviewing the child, parents, or other relevant people.
    • Reviewing important documents, such as medical or school records.
    • Making recommendations to the court about what actions would best serve the person’s interests.
    • Attending court hearings and presenting their findings to the judge.

  4. Who Can Be a Guardian Ad Litem?
In Nevada, a GAL is often a trained volunteer, attorney, or social worker with experience in family law or child welfare. They must be impartial and focused on the best outcomes for the person they represent.

  5. The GAL’s Role in Court
The GAL does not act as a lawyer but works closely with attorneys and the judge to ensure all decisions are fair and beneficial to the person they represent.
