Choosing the Right Person to Make Your Health Care Decisions

One of the most important parts of an estate plan isn’t about money—it’s about making sure someone you trust can speak for you if you cannot speak for yourself.

  • Is available and willing to serve when needed.

The more your agent understands your values, the more confidently they can make decisions that reflect what you would have wanted.

Serving as a health care agent is a significant responsibility. Depending on the circumstances, your agent may need to review treatment options, consent to or refuse medical procedures, authorize transfers between facilities, and work with physicians to ensure your care aligns with your stated wishes and best interests.

Review your Advance Directive periodically, especially after major life events such as marriage, divorce, the birth of a child, or the death or incapacity of your chosen agent. Updating your documents ensures the right person is prepared to advocate for you when it matters most. If the first chosen agent cannot act for you, considering an appropriate “back-up” agent is also very important.
